Right to Buy - Policy and Practice

This course forms part of the joint training programme which East Midlands Councils has developed with the Chartered Institute of Housing. It will be delivered by CIH Associate, Emily Gasson.

The Government has “reinvigorated” the Right to Buy. Since the 2nd April 2012 discounts have been substantially increased and the proceeds have been ring fenced to fund the development of new affordable housing. Cost floor provisions have changed. The increased discount will lead to a significant increase in the number of right to buy applications.  Provision has been made to cover the cost of the rise in applications.

This course will provide you with a detailed understanding of Right to Buy legislation (including decided cases). It will also enable you to write RTB procedures and follow them in practice. It is designed to help practitioners keep up to date and to develop their skills in what is likely to be an increasingly important area of work in the future.

At the end of this course you will be able to:

  • Recognise who is entitled to exercise the RTB and who can be joined as a purchaser
  • Implement an action plan to reduce fraud
  • Develop a means of getting the best price for the property
  • Understand eligibility and cases where the RTB cannot be exercised
  • Apply rules about calculation or qualifying period, discount and operation of the cost floor
  • Act appropriately when circumstances change during the procedure, including on death of the applicant
  • Apply the preserved right to buy
  • Understand the right to acquire in outline
  • Confidently implement the procedures up to completion of the purchase
  • Apply procedures concerning recovery of discount and landlord's right to first refusal
