Exit Payment Cap

EMC is working with its counterparts across the country and the LGA to collate views in order to inform and develop a response to the consultation ahead of the deadline.   We are  interested in any views or evidence that you have as local authorities, to inform the LGA’s response as well as a regional response. 

This note is to provide information and an opportunity to feed in a response on the further round of consultation that the Government has recently launched on proposals to implement an exit pay cap within the public sector.

It sets out the proposed draft regulations, schedule to the regulations, accompanying guidance and directions.  The consultation closes on 3 July 2019

The LGA has produced a briefing note, a copy of which is attached below.

In support of this, please would you complete a survey that is being organised on behalf of all regional employers by one of our counterparts – South East Employers (SEE).  Please provide your authority’s initial views on the areas featured in the consultation by completing the form here.  The deadline for responses to the survey is 17 May 2019.  SEE have produced some guidance notes which may be helpful in completing the survey (see attachment below)

It would be helpful to our local government community if as many responses were made as possible to this survey. 

For our part, we will:-

  1. Collate and forward your responses to the LGA to assist them in providing a national response. 
  2. Use the information you provide to inform a regional response
  3. Circulate the national and regional collations as soon as they are prepared to help inform your thinking for an individual response you may wish to send direct to Government nearer the 3 July deadline.

EMC has produced an outline of the key changes from the previous proposals and responses to queries received so far (attached below).  We will also answer any further questions you have about the current proposal - as far is possible at this stage – and will update our FAQ accordingly.   In the meantime, we will provide an analysis of the draft regulations and guidance from an employment law expert in our next HR Bulletin, due to be published on Tuesday.
